Welcome to DC Hub. By accessing or using our platform at dchub.cloud ("Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By creating an account, accessing, or using DC Hub, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
DC Hub provides a data center intelligence platform including:
- Facility database and search
- Market intelligence and analytics
- Land & Power infrastructure mapping
- AI-powered research assistant
- News aggregation and transaction tracking
- API access (for qualifying subscription tiers)
3. Subscription Plans & Pricing
DC Hub offers the following subscription tiers:
- Founding Member: $99/month (limited availability)
- Pro: $199/month
- Enterprise: $699/month
Prices are subject to change with 30 days notice. All fees are non-refundable except as required by law or at our sole discretion.
4. Intellectual Property Rights
⚠️ IMPORTANT: All content, code, data, designs, features, and functionality of DC Hub are the exclusive property of DC Hub and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
4.1 Ownership
DC Hub retains all rights, title, and interest in:
- The DC Hub platform, software, and source code
- Proprietary datasets, algorithms, and analytics
- User interface designs and visual elements
- The DC Hub name, logo, and trademarks
- Documentation and educational content
4.2 License to Use
Subject to these Terms, DC Hub grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes only.
4.3 Restrictions
You may NOT:
- Copy, modify, or create derivative works of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Scrape, crawl, or systematically download data from the Service
- Redistribute, resell, or sublicense access to the Service or its data
- Remove or alter any copyright, trademark, or proprietary notices
- Use automated tools to access the Service beyond approved API limits
- Build a competing product using data or insights from DC Hub
- Share login credentials or allow unauthorized access
5. Data Usage & Restrictions
5.1 Permitted Uses
You may use DC Hub data for:
- Internal research and analysis
- Site selection and market evaluation
- Investment due diligence
- Business presentations (with attribution)
- API integration with your internal systems (Enterprise tier)
5.2 Prohibited Uses
You may NOT:
- Republish or redistribute DC Hub data to third parties
- Create derivative databases from DC Hub data
- Use DC Hub data to train machine learning models
- Sell or license DC Hub data in any form
- Bulk export data beyond reasonable personal use
5.3 Attribution
When using DC Hub data in external presentations or publications, you must include attribution: "Source: DC Hub (dchub.cloud)"
6. API Terms (Enterprise Tier)
Enterprise subscribers receive API access subject to:
- Rate limits as specified in your subscription agreement
- Use only for internal business applications
- No reselling or redistributing API data
- Compliance with all usage guidelines
API abuse may result in immediate termination without refund.
7. User Conduct
You agree to:
- Provide accurate registration information
- Maintain the security of your account credentials
- Use the Service only for lawful purposes
- Not interfere with or disrupt the Service
- Not attempt to gain unauthorized access
- Report any security vulnerabilities responsibly
8. Data Sources & Accuracy
DC Hub aggregates data from multiple public and proprietary sources. While we strive for accuracy:
- Data is provided "as is" without warranty of accuracy
- Information may be outdated or incomplete
- You should independently verify critical data
- DC Hub is not liable for decisions made based on our data
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
DC Hub does not warrant that:
- The Service will be uninterrupted or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
- Data will be accurate, complete, or current
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DC HUB AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO DC HUB IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless DC Hub, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of any applicable law
12. Termination
We may suspend or terminate your access immediately, without notice, for:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Non-payment of fees
- At our sole discretion for any reason
Upon termination, your right to use the Service ceases immediately. Sections 4, 5, 9, 10, 11, 13, and 14 survive termination.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict of law principles.
Any disputes shall be resolved through binding arbitration in Phoenix, Arizona, under the rules of the American Arbitration Association. You waive any right to a jury trial or class action.
14. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and DC Hub.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Failure to enforce any provision does not constitute a waiver.
- Assignment: You may not assign these Terms without our consent.
- Modifications: We may modify these Terms at any time. Continued use constitutes acceptance.
